1. Acceptance of Terms

By accessing, browsing, or using this website (Kaizen Speedworks), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this site or purchase products from Kaizen Speedworks.

2. "Off-Road Use Only" & Emissions Compliance

CRITICAL NOTICE FOR ALL CUSTOMERS: Many parts sold by Kaizen Speedworks (including but not limited to exhausts, turbo kits, ECU tuners, and downpipes) are designated as "RACE ONLY" or "OFF-ROAD USE ONLY."

• Public Highway Use: These products are NOT legal for use on public highways, streets, or roads in the United States. They are intended solely for use on dedicated racing vehicles that will never be driven on public roads.

• Customer Responsibility: It is the customer's sole responsibility to ensure their vehicle complies with all Federal, State (including CARB), and Local laws.

• Liability Waiver: By purchasing these parts, you release Kaizen Speedworks from any liability associated with tickets, fines, impoundment, or insurance denial resulting from the use of non-compliant parts.

3. Warranties & Disclaimers

Kaizen Speedworks is a Retailer, Not a Manufacturer.

• No Store Warranty: Kaizen Speedworks does not manufacture any of the products we sell and therefore offers no warranty of its own, express or implied.

• Manufacturer Warranty: All products are sold subject to the warranty policies (if any) of the respective manufacturer (e.g., HKS, Tein, Garrett).

• Warranty Processing: If you have a warranty claim, we will assist you in contacting the manufacturer, but the final decision on repair or replacement lies solely with the manufacturer.

  • Note: Most manufacturers will void warranties if the part was not installed by a certified professional.

4. Orders, Pricing, & Cancellations

• Order Acceptance: Your receipt of an electronic order confirmation does not signify our acceptance of your order. Kaizen Speedworks reserves the right at any time after receipt of your order to accept or decline your order for any reason.

• Pricing Errors: In the event a product is listed at an incorrect price due to a typographical error or error in pricing information received from our suppliers, Kaizen Speedworks shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price.

• Cancellations:

  • In-Stock Items: May be cancelled before they ship.

  • Special Order / JDM Import Items: Once a Special Order is placed with our overseas supplier, it cannot be cancelled or refunded.

5. Limitation of Liability

In no event shall Kaizen Speedworks, its directors, officers, employees, or agents be liable for:

1. Mechanical Failure: Any damage to your engine, drivetrain, or vehicle resulting from the installation or use of products sold.

2. Installation Errors: Damages caused by improper installation (we highly recommend professional installation).

3. Consequential Damages: Lost profits, loss of use, towing fees, rental car fees, or labor costs associated with removing or replacing parts.

Your use of any product purchased from Kaizen Speedworks is at your own risk.

6. Indemnification

You agree to indemnify, defend, and hold harmless Kaizen Speedworks and its affiliates from any claim, demand, or damage—including reasonable attorneys' fees—asserted by any third party due to or arising out of your use of our products or your violation of these Terms.

7. Shipping & Risk of Loss

All items purchased from Kaizen Speedworks are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (UPS, FedEx, DHL, etc.). We are not responsible for lost or stolen packages once the carrier marks them as "Delivered."

8. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this agreement shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
